System Maintenance Agreement

Terms and Conditions

  • Maintenance Service:
    • Phones Plus.Biz will provide Maintenance Service as long as the Purchaser is not in default. Maintenance Services set forth will be performed in accordance with generally accepted telephone industry standards and may be performed during phones Plus.Biz normal business hours.
    • The customer will promptly advise Phones Plus.Biz of any communication system defect or malfunction, regardless of cause.
    • Phones Plus.Biz maintenance responsibilities do not extend to equipment of the public telephone network, nor is Phones Plus.Biz responsible for difficulties in the communication system caused by malfunctions in the public telephone network, or caused by misuse or abuse of the communication system.
      ****Phones Plus.Biz will include troubleshooting assistance of the public telephone network.****
    • The maintenance service contract covers all maintenance services described in section III A and B. Customer will pay all charges not covered within thirty (30) days after date of invoice. Additional service charges will be in accordance with the rates then in effect.
  • Use of Communication System:
    • During the maintenance term the customer will operate the communication system strictly in the manner proposed by Phones Plus.Biz. The Customer will not alter or permit the alteration of any of the equipment without the prior written consent of the Phones Plus.Biz.
    • Moves, adds and changes to the communication system equipment must be done by Phones Plus.Biz personnel only, or with prior approval of Phones Plus.Biz. Should the equipment be serviced by outside, unauthorized parties, this contract will no longer be valid as written and may be cancelled without refund.
    • Phones Plus.Biz reserves the right to inspect the communication system and observe its use and operation at all times.
  • Corrective Maintenance:
    • Phones Plus.Biz will furnish the following corrective maintenance without additional charge in consideration of the Maintenance Service Agreement: Repair of equipment malfunctions will be performed by Phones Plus.Biz trained technicians, including all material and labor during Phones Plus.Biz normal working hours. Service for major system failure (defined as total lack of communication for incoming, outgoing, or internal communication) will be provided seven (7) days a week, twenty-four (24) hours a day. Response time will not exceed two (2) hours from time of notification during normal working hours. For minor system failures (definded as inoperative single telephone stations, inoperative single line cards, trunk cards, dials, etc…) service will be provided during normal working hours. Response time will not exceed two (2) service days.
    • This contract does not cover damage caused by power surges, lightning, flooding, or other acts of God. All service repair of this type (acts of God) will require payment at time of service. Insurance claims will be between the Customer and their respective insurance carrier.
